As it is known, with the amendment (R.G.13.05.2022) of the Regulation on the Implementation of the Turkish Citizenship Law (20.Art/2-b), the real estate acquisition value for the purpose of acquiring Turkish citizenship has been increased from 250,000 USD to 400,000 USD, to be effective 1 month later.
In this context, an instruction was issued to determine how to finalize the final transaction requests in the transition process with the USD 250,000 application in effect until 13.06.2022, and a frequently asked questions study was conducted in accordance with this instruction.

Until what date is the 1-250.000 USD application valid?

Applications made to our directorates in person or via webtapu/ALO181(webtapu) until 12.06.2022 at 24:00 will be considered over a value of 250,000 USD. In other words, for example, in the case of an application made on 13.06.2022, an evaluation is made over 400,000 USD.

2- Applications made through which channels will be considered valid?

3-The application was made until 13.06.2022, but there are missing documents, in this case, what kind of method is followed by the land registry office?

If any of the documents that determine the value (currency purchase document, valuation report and receipt) are missing, the application will be terminated by informing the relevant person.

 

4- How long can the land registry directorate hold the application in case of missing documents other than the document determining the value?

In case of deficiencies arising from documents other than the documents determining the value, if the claimants do not apply to the directorate within 20 days, the relevant persons are notified by sending an SMS that "if they do not apply to the directorate within 10 days, the transaction will be cancelled".

 

5-I applied before13.06.2022 and my transaction was canceled due to a deficiency in determining the value. How will my application be evaluated after 13.06.2022?

Applications received before 12.06.2022 at 24:00 but canceled due to deficiencies in value-based documents (currency purchase document, valuation report and receipt) should be renewed after 13.06.2022 and new documents (currency purchase certificate, valuation report and receipt) subject to value should be renewed. receipt) If it is determined that it was issued before 13.06.2022, the transaction is completed based on the value of 250,000 USD, regardless of the renewed application date.

For citizenship by the foreign national AA on 09.06.2022
An annotation/commitment application has been made, but in case the application is closed due to the fact that the receipt value is not worth 250,000 USD in the examination made by the relevant directorate on 10.06.2022, in case an additional receipt dated 10.06.2022 is submitted by the foreign national AA, the application will be renewed on 15.06.2022 and processed over 250,000 USD. possible to continue.

 

7- What is the method to be applied if there is no deficiency in value-based documents at the stage of certificate of conformity (regional directorate), but there is a deficiency in other documents?

A value of 250,000 USD has been provided at the stage of the certificate of conformity, and if there is no deficiency in the value-based documents (currency purchase document, valuation report and receipt), the ongoing transactions due to other deficiencies are concluded even after 12.06.2022, if the relevant deficiencies are completed, over the value of 250,000 USD. If the commitment is unintentionally removed during the completion of other deficiencies, the commitment is renewed and the process continues.

 

8- What is the method to be applied in case of a deficiency in value-based documents at the stage of certificate of conformity (regional directorate)?

If the citizenship commitment has been taken but the commitment is canceled due to the fact that the 250,000 USD value sought at the stage of the conformity certificate is not provided or the missing documents (currency purchase document, valuation report and receipt) cannot be completed

If a promise of sale contract has been drawn up at the notary public or the sale or promise of sale annotation has been registered at the land registry office, but the citizenship annotation/commitment has not been received and there is no annotation/commitment application within the framework of the specified procedures, the value of 400,000 USD is sought for the applications to be made after 13.06.2022.

10- The immovable property was purchased before 13.06.2022 or an annotation was made for the promise of sale, but no annotation/commitment was put. Can you explain with an example, can a 3-year unsold annotation be put after 13.06.2022 in order to benefit from 250,000 USD?

Foreign national BB bought the immovable
property no. 101, parcel 1, number 1 on 11.06.2022, but the immovable is not sold for 3 years.
did not put the annotation/commitment. Foreign national BB applied to the land registry office on 20.06.2022 and applied for an annotation/commitment for citizenship.
In this case, even if the person makes a sale before 13.06.2022, the 3 years unsellable annotation/commitment for citizenship will be subject to the provisions of 400,000 USD since it is made after 13.06.2022.
