As it is known, with the amendment (R.G.13.05.2022) of the relevant regulation (20.Art/2-b), the real estate acquisition value for the purpose of acquiring Turkish citizenship has been increased from 250,000 USD to 400,000 USD, effective 1 month later.
In this context, applications made to our directorates in person or via webtapu/ALO 181(webtapu) until 12.06.2022 and 24:00 will be considered over the value of 250,000 USD, and the ongoing final processing processes must be completed as follows;
1- Applications made via webtapu or ALO 181(webtapu) until 12.06.2022 and 24:00 will be considered valid, e-appointment (https://randevu.tkgm.gov.tr/tr/Appointment/eAppointmentStart) Applications made through the website will not be accepted due to the inability to enter the party and transaction information.
2- An annotation/commitment application has been received until 12.06.2022 at 24:00, or in the transaction explanation sections of the web title sales transaction applications or in the sales application slip issued later in the land registry office for web title sales transaction applications, in addition to the sale transaction, for citizenship In cases where an annotation/commitment transaction application is received, the conformity certificate process continues and the transaction is completed over the value of 250,000 USD, provided that the transaction parties do not change.
3- If any of the documents that determine the value (currency purchase document, valuation report and receipt) are missing, the application will be finalized by informing the person concerned. In case of deficiencies arising from documents other than the documents determining the value, if the applicants do not apply to the directorate within 20 days, "the transaction will be canceled if they do not apply to the directorate within 10 days".
4- Applications for which applications were received before 12.06.2022 at 24:00 but canceled due to missing value documents (currency purchase document, valuation report and receipt) should be renewed after 13.06.2022 and new documents based on value (currency purchase receipt) should be renewed. document, valuation report and receipt) is issued before 13.06.2022, the transaction is completed based on the value of 250,000 USD, regardless of the renewed application date.
For example; An annotation/commitment application for citizenship was made by the foreign national AA on 09.06.2022, but in case the application was closed because the receipt value was not found to be worth 250.000 USD in the examination carried out by the relevant directorate on 10.06.2022, if an additional receipt dated 10.06.2022 is submitted by the foreign national AA It is possible to renew the application on 15.06.2022 and continue the process over 250,000 USD.
5- Citizenship commitment has been taken and a value of 250,000 USD has been provided at the stage of the certificate of conformity, but the ongoing transactions due to other deficiencies are concluded over the value of 250,000 USD if the relevant deficiencies are completed even after 13.06.2022. If the commitment is unintentionally removed during the completion of other deficiencies, the commitment is renewed and the process continues.
6- If the citizenship commitment has been received but the commitment is canceled due to the fact that the 250,000 USD value sought at the stage of the conformity certificate has not been met or the deficiencies in the documents based on the value (currency purchase document, valuation report and receipt) have not been completed (except for the exception of Article 4), the commitment to be taken after 13.06.2022 400,000 USD value is sought in the transaction.
7- If a promise of sale contract has been drawn up at the notary, or if the sale or promise of sale annotation has been registered at the land registry office, but the citizenship annotation/commitment has not been received or there is no annotation/commitment application within the framework of the specified procedures, the value of 400,000 USD is sought for the applications to be made after 13.06.2022.
For example: Foreign national BB bought real estate 101, block 1, parcel no. 1 on 10.06.2022, but did not commit to not selling the real estate for 3 years. Foreign national BB applied to the land registry office on 20.06.2022 and applied for a commitment annotation for citizenship. In this case, even if the person makes a sale before 13.06.2022, he will be subject to the provisions of 400,000 USD if he wants to make a 3-year commitment not to sell for citizenship after 13.06.2022.
Hesitant issues regarding the transition process are coordinated with the Foreign Affairs Department.
Regarding the completion of the final processing processes of 250,000 USD before the effective date of the regulation change;
